Metagenics, Ethical Nutrients & Inner Health

These Terms govern your access to and use of the Metagenics, Ethical Nutrients and Inner Health websites and any purchases made on these Sites.

Agreement & Scope

These Terms of Service constitute a legal agreement between you (the individual using this Site) and Metagenics (Aust) Pty Ltd ("Metagenics", "we", "us"). By creating an account, checking out as a guest, logging into your account, or by browsing, downloading, installing or otherwise accessing and using this Site, you represent that you have read, understand and agree to be bound by these Terms of Service, as updated from time to time. If you do not agree, do not access or use this Site.

Metagenics may modify these Terms of Service at any time. It is your responsibility to review the Terms when you access this Site.

Definitions

For the purposes of these Terms of Service, "Products" means Metagenics, Inner Health and Ethical Nutrients products.

International Use

If you are viewing this Site outside Australia, you agree that you are responsible for complying with your local laws; Metagenics has no liability for your use; and you indemnify Metagenics for any third-party liability arising from your use of this Site.

Medical Disclaimer

Information on this Site is not a substitute for medical advice or treatment. Consult your healthcare practitioner for health concerns. Use of or reliance on Site information is at your own risk. We provide no assurance the information is the most up-to-date medical research.

License and Access

Subject to your compliance with these Terms, Metagenics or its licensors grant you a limited, non-exclusive, non-transferable, non-sub-licensable license to access and make personal and non-commercial use of the Services.

  • This license does not include resale or commercial use, collection of product listings/prices, derivative use, use of account info for third parties, or data-mining/robots.
  • All rights not expressly granted are reserved by Metagenics and its licensors.
  • Services or any part may not be reproduced, duplicated, copied, sold, resold or exploited for commercial purposes without written consent.

The license terminates if you do not comply with these Terms of Service.

Creating an Account

You may create an account with your name and email. Registered Users can manage addresses and view orders. An Account is not required to submit an Order.

By creating an Account you confirm you have authority to form a binding agreement, and you must provide and maintain accurate information. You are responsible for all activity on your Account and must notify us immediately at info@metagenics.com.au of any unauthorised use.

Metagenics may refuse service, terminate Accounts, remove or edit content and cancel Orders at its sole discretion. If your access was previously terminated, you may not access the Site again.

Practitioner Linked Account Holders

If your Practitioner links you to their account, you may purchase recommended Products via a Practitioner Linked Account. Your Practitioner will be notified of volumes purchased and will receive monthly statements that include your name and quantity of units purchased. Purchasing as a Practitioner Linked Account Holder means you consent to us sharing your purchase history with your Practitioner.

If an invitation to link is not acted upon within 12 months it will expire. To unlink, contact Customer Service on 1800 777 648 or email info@metagenics.com.au and info@metagenics.co.nz. Allow 48 hours for unlinking to take effect.

Coupons & Promotional Codes

Coupons/promotional codes are for individual use only and may not be transferred. Metagenics may cancel orders or terminate offers if misuse or fraud is suspected.

Guest Check-Out

You may purchase as a Guest without an Account. By submitting your email as a Guest User you consent to contact about your Order and — if opted in — marketing per our Privacy Policy.

Subscriptions

Subscriptions supply selected Products at a chosen frequency. If you have an Account you may manage subscription frequency online. Subscriptions continue until cancelled. Modify or cancel at least 24 hours before the next scheduled order to avoid being charged; changes within 24 hours may not take effect for the pending shipment.

To cancel, log in and go to Manage Subscriptions, or contact Customer Service on 1800 777 648.

Placing Orders

Follow the Site instructions to place and change Orders before submission. Product purchases are subject to availability. When you submit an Order you agree to the Terms of Service in force at that date. You are responsible for reviewing the latest Terms each time you submit an Order.

Order acknowledgement email will include a reference number and may contain estimated shipping details.

Metagenics may refuse Orders for reasons including: inability to obtain payment authorisation, shipping restrictions, out-of-stock items or quality control issues, withdrawal of products, or if you do not meet eligibility criteria. Metagenics is not liable for withdrawing Products, removing content, refusing transactions or unwinding transactions after processing has begun.

Products purchased as a Guest or Practitioner Linked Account are for personal use only and may not be resold. Metagenics may restrict quantities per address.

Product Descriptions

Metagenics attempts accuracy in product descriptions but does not warrant descriptions or content is error-free. If a Product is not as described your sole remedy is to return it in unused condition consistent with the Returns Policy.

Medical, Nutrition and Fitness Information

All content (medical, nutrition, images, video, etc.) is for informational purposes only and not a substitute for professional healthcare advice. Consult your healthcare professional before using Products or relying on information on the Site.

Transmission of content does not create a doctor-patient relationship with Metagenics or affiliates.

Links to Third Parties

This Site may link to third-party websites for convenience only. No endorsement is implied. Your use of third-party sites is subject to their terms and privacy policies.

Use of Materials

The Materials on the Site are Metagenics' property and protected by intellectual property laws. You agree not to reproduce, modify, distribute, adapt or otherwise use Materials without prior written consent.

Warranties, Disclaimer & Limitation of Liability

This Site is provided on an "as is" basis without express or implied warranty. You are responsible for assessing material suitability. You accept the risks and responsibility for loss or damage from use of the Site or purchase of Products.

To the extent permitted by law, Metagenics' liability is limited. Statutory non-excludable conditions (e.g. Competition and Consumer Act 2010 (Cth)) remain unaffected. Where permitted, liability may be limited to replacing the product or refunding its cost, and overall liability shall not exceed amounts actually received by Metagenics for the Product that gave rise to the claim.

Release and Indemnity

You agree to release, hold harmless and indemnify Metagenics and related parties from all liability, losses, damages, expenses and costs arising from your use of the Site, purchase of Products, breach of these Terms, or violation of law.

Ratings & Reviews

When submitting content as part of a rating or review you warrant you are the author, at least 18 years old, content is not false or defamatory, and you have not been compensated. You grant Metagenics a perpetual, irrevocable, royalty-free license to use, modify, publish and distribute your content without compensation.

Metagenics may contact you about your content and may collect, use and store personal information associated with ratings/reviews; see the Privacy Policy for details.

Applicable Law & Jurisdiction

These Terms and any disputes will be governed by the laws of Queensland, Australia.

Severability, Waiver and Assignment

If any provision is found illegal or unenforceable, it will be severable without affecting remaining provisions. No failure by Metagenics to enforce any part of these Terms shall be a waiver. You may not assign these Terms without Metagenics' prior written consent; Metagenics may assign without notice.

Changes to Terms

Metagenics may modify these Terms at any time and will publish updates on the Site. Continued use after changes constitutes acceptance. If you disagree with modifications, cease using the Site immediately.

Termination

Metagenics may terminate your right to access the Site at any time without notice.

Terms of Service — Metagenics Institute

The Metagenics Institute Site is intended for Healthcare Practitioners in Australia and New Zealand only. These Terms govern your access to the Metagenics Institute Site and operate as a legal agreement between you and Metagenics. By using the site you consent to these Terms and the Privacy Policy.

The Institute Site content is for general information only and not a substitute for professional advice. The Site may contain inaccuracies and is offered without warranties. Changes to content or features may be made at any time. Continued use after changes constitutes acceptance.

Metagenics grants a personal, non-exclusive, non-transferable license to print and display Materials for non-commercial, personal use only, subject to maintaining copyright notices.

The Institute Site is provided "as is". You accept responsibility for assessing suitability of information and release Metagenics from liability for losses arising from use.

Jurisdiction

These Institute Terms are governed by the laws of Queensland, Australia, and you submit to the exclusive jurisdiction of the Courts of Queensland and the Queensland Registry of the Federal Court of Australia.
